Welcome to Near & Dearest

Near & Dearest is a small Hamilton-based studio making personalised photo magnets and keepsakes: Little pieces of joy, made just for you. This website and online store is powered by Shopify and run by us ("we", "us", "our"). By browsing, shopping, or interacting with us, you ("you", "your") are agreeing to these Terms of Service and our Privacy Policy.

1. Who Can Shop With Us

You need to be 18 or over to place an order, or have the permission of a parent or guardian. By ordering, you confirm that the information you've provided is accurate.

2. Our Products

We do our best to represent our magnets and other products accurately, but colours may vary slightly depending on your screen. Every order is custom made, so there may be small variations. That's part of what makes each one special.

Print quality is directly tied to the images you provide. We recommend uploading clear, high-resolution photos with good lighting. We're not responsible for print outcomes resulting from low-quality, blurry, or heavily compressed images supplied by the customer.

We may update, change, or discontinue products at any time.

3. Placing an Order 

All Near & Dearest products are made to order. Please review your uploads and details carefully before confirming, as we begin production promptly and may not be able to make changes once your order is placed. You'll receive a confirmation email when your order is received and again when it's dispatched.

4. Pricing & Payment

All prices are in NZD. Shipping is charged separately unless otherwise stated. Promotional offers may have their own terms and conditions.

5. Shipping & Delivery 

We ship New Zealand-wide from Kirikiriroa Hamilton. Please allow up to 5 working days for your order to be made and dispatched. Once it's with the courier, delivery times may vary, particularly during busy periods. For full details, see our Shipping Policy.

6. Your Photos & Content

By uploading images or personalisation details, you confirm that you have the right to use them and that they don't infringe on anyone else's rights. Your photos are used solely to fulfil your order unless you've given us separate consent to use them on social media.

We will not produce orders containing offensive, pornographic, hateful, illegal, or otherwise inappropriate content. We reserve the right to cancel and refund any order where uploaded content falls into these categories, as determined by us.

7. Intellectual Property

All Near & Dearest branding, imagery, and content is our own. You're welcome to share your order on social media and tag us, but please don't reproduce or use our brand assets without permission.

8. Shopify

Our store runs on Shopify. Your purchase is a transaction between you and Near & Dearest. Shopify is our platform provider and is not a party to your order.

9. Privacy

We take your privacy seriously. Please read our Privacy Policy to understand how we collect and use your information.

10. Feedback & Reviews 

We love hearing from our customers! If you share a review or story with us, we may use it to promote our products (with your name if you're happy for us to, or anonymously). Please only share content that is honest and your own.

11. Errors & Updates 

Occasionally there may be errors in product descriptions, pricing, or availability. We reserve the right to correct these and to update or cancel orders where necessary.

12. Fair Use 

We ask that you use our website respectfully: No spam, no harmful content, no impersonation, and no misuse of our systems.

13. Ending Access 

We may suspend or end access to our store at any time, particularly if these terms are not followed. Any outstanding obligations remain in place.

14. Emails & Marketing 

If you join our mailing list, we'll only send occasional updates, new product news, or special offers. You can unsubscribe at any time.

15. Legal 

Our products and services are provided in good faith. To the extent permitted by law, we're not liable for indirect or consequential losses. These terms are governed by the laws of New Zealand, and any disputes will be handled in New Zealand courts.

16. Changes to These Terms 

We may update these terms from time to time. Changes will be posted here, and your continued use of our store means you accept the updated version.
